Here is a breakdown of the Forgery Charges and Sentencing Limits. I’m also attaching pdf copies of the Arkansas Forgery Statute, Sentencing Statute, and Multiple Sentence Statute for your convenience.

Forgery Charges – Pursuant to Arkansas Code Annotated 5-37-201 – Forgery: Subsection (b) states that “A person commits forgery in the first degree if he or she forges a written instrument that is:

(1)Money, a security, a postage or revenue stamp, or other instrument issued by a government; or”

Further, pursuant to Arkansas Code Annotated 5-37-201 – Forgery: Subsection (d) states that “Forgery in the first degree is a Class B Felony.”

Sentencing Limitations – Pursuant to Arkansas Code Annotated 5-4-401 – Sentence: Subsection (a)(1) states that “For a Class B felony, the sentence shall be not less than five (5) years nor more than twenty (20) years”

Multiple Sentences – Pursuant to Arkansas Code Annotated 5-4-403 – Multiple Sentences – Concurrent and Consecutive Terms: Subsection (a) states that “When multiple sentences of imprisonment are imposed on a defendant convicted of more than one (1) offense, including an offense for which a previous suspension or probation has been revoked, the sentences shall run concurrently unless, upon recommendation of the jury or the court’s own motion, the court orders the sentences to run consecutively.
